Before attending law school, Dan Mabry spent over twenty years as a metallurgical engineer and an owner/operator/manager of a heavy industrial manufacturing facility producing engineered custom iron castings servicing original equipment manufacturers.  During that time he served on the state and national boards of his industry’s technical society and was named Small Businessman of the Year by the Beaumont Chamber of Commerce in 1989.  He sold his business in 1996, obtained a law degree and joined Strong Pipkin in 1998.  In twenty years of managing a manufacturing business he handled contract matters, regulatory agency matters, labor issues and coordination with outside counsel in general litigation matters.  This experience gives him a unique perspective as a trial lawyer.  Simply put, Mabry knows your business and concerns.  He is an attorney who seeks not only to obtain a favorable outcome, but to do so in a cost effective manner.  Since 1998 Mabry has handled a wide range of litigation and transactions for clients in Texas and Louisiana including employment law cases, contract disputes and regulatory agency matters.

Primary Practice Areas:

Business Transaction and Commercial Litigation

  • Successfully defended employers in Fair Labor Standards Act (FLSA) litigation, drafted and successfully enforced employee/independent contractor non-compete agreements
  • Negotiated business transactions (both simple and complex) and prepared documents to “paper up” all stages of those transactions including non-disclosure agreements, term sheets, memorandums of understanding, and the final deal documents for execution at closing
  • Successfully enforced clients’ contracts breached by opposing parties, and defended clients wrongfully sued for breach of contract and associated claims
  • Obtained temporary restraining orders and injunctions to protect clients’ contractual rights and proprietary trade secret information pending resolution of underlying dispute

Regulatory Agency Matters

  • Worked with the TCEQ to obtain an extension of a manufacturing company’s air operating permit – – over four years after same expired, without paying any penalties or fines
  • Coordinated with agency in response to public complaints against clients
  • Assisted manufacturing companies with identifying and correcting areas of regulatory non-compliance by conducting and coordinating a self-audit pursuant to the Texas Environmental, Health, and Safety Audit Privilege Act

Real Estate

  • Represented clients in transactions involving the acquisition and sale of real estate
  • Represented clients in actions to quiet title to real property
